Results

  • Brought one of the first successful federal telecommunications "shot-clock" lawsuits in the nation, securing approvals to construct a cellular tower from a municipality that failed to act within the time limits established by the Federal Communications Commission
  • Served as lead trial counsel in federal cases involving the siting of numerous wireless facilities in California, Arizona, New York, New Jersey, and New Hampshire
  • Successfully represented a commercial real estate developer in an environmental dispute with New York State concerning the remediation of a hazardous waste disposal site
  • Obtained a favorable decision in Freedom of Information Law (FOIL) litigation to compel a large municipality on Long Island to disclose certain records that the municipality unlawfully sought to withhold by invoking the “law enforcement exemption” contained in Public Officers Law §87(2)(e)(i)
  • Extricated a large tower developer from a contentious mortgage foreclosure proceeding, leaving its interest wholly immune from attack by a foreclosing lender
  • Obtained a dismissal on behalf of a corporate client wrongfully accused of civil rights violations under 42 U.S.C. Section 1983
  • Secured one of the few published determinations on behalf of a client which overturned a municipal permissive referendum for failure to comply with the petition authentication requirements of Election Law Section 6-140
  • Successfully defended a national client where the landlord of an adjoining building in New York City alleged trespass into the landlord’s portion of a shared party wall
  • Negotiated a favorable discontinuance on behalf of its corporate client in connection with utility interference lawsuit commenced in the Supreme Court of Queens County
  • Succeeded in defending a municipal determination as to zoning immunity under the Monroe Balancing Test first articulated by the Court of Appeals in Matter of County of Monroe, 72 N.Y.2d 338, 530 N.E.2d 202 (1988)

The First Amendment guarantees the right to petition our government. But “the right to be heard does not automatically include the right to be taken seriously.” 19 Stanford Law & Policy Review 32, n.22 (2008). Our clients are taken seriously.

We are registered lobbyists in the City of New York where we have been involved in the development of fiber optic, wind energy, cellular telephone and public safety radio networks. We bring that commitment to each lobbying assignment we accept.
